Terms and Conditions of Runway 34 Sim Academy AG

Scope

The following General Terms and Conditions (GTC) apply to the use of this website and to the business relationship between Runway 34 Sim Academy AG, Rohrholzstrasse 67, 8152 Glattbrugg and its customers. These GTC are valid in the version available and applicable at the time of accessing the website or ordering goods/services.

This website's offer is exclusively aimed at customers residing in Switzerland or the EU.

A customer is defined as any natural or legal person who maintains business relations with Runway 34 Sim Academy AG. The Terms and Conditions, delivery and payment terms, and data protection regulations may be subject to adjustments from time to time. Runway 34 Sim Academy AG requests that these provisions be read carefully on each visit to the website and for every order of goods.

These terms and conditions apply exclusively. Any terms and conditions that conflict with, supplement, or deviate from these terms and conditions require express written confirmation from Runway 34 Sim Academy AG to be valid.

By using this website or ordering goods/services, the customer fully acknowledges and accepts these terms and conditions, including the delivery and payment terms.

Should individual provisions of these GTC prove to be ineffective or unenforceable, or become ineffective or unenforceable, the effectiveness of the remaining provisions shall remain unaffected.

Prices

The prices stated by Runway 34 Sim Academy AG include, unless otherwise stated, the statutory value added tax, any advance recycling fees (ARF) and copyright levies on electronic devices. The prices are net in Swiss Francs (CHF).

Any shipping costs will be charged additionally, unless otherwise agreed, and are to be paid by the customer. Shipping costs will be shown separately in the ordering process.

Technical changes, errors and printing errors are reserved for Runway 34 Sim Academy AG; in particular, price changes can be made at any time without prior notice. Consulting and support services are not included in the sales prices.

Contract conclusion

The offers on this website represent a non-binding invitation to the customer to order products and/or services from Runway 34 Sim Academy AG. By ordering via this website, including accepting these terms and conditions, the customer submits a legally binding offer to conclude a contract. Runway 34 Sim Academy AG will then send an automatic „order confirmation“ by email, which confirms that the customer's offer has been received by Runway 34 Sim Academy AG. Orders placed are binding on the customer. Unless otherwise stated, there is no right of return or withdrawal.

The contract is concluded as soon as Runway 34 Sim Academy AG sends an email confirming acceptance, stating the dispatch of the ordered products or services.

Orders will only be dispatched after full payment has been received (exception: invoicing) and provided the goods are available. If it transpires after the contract has been concluded that the ordered goods cannot be delivered, or cannot be delivered in full, Runway 34 Sim Academy AG is entitled to withdraw from the entire contract or part of a contract. Should payment from the customer have already been received by Runway 34 Sim Academy AG, the payment will be refunded to the customer.

If no payment has been made yet, the customer will be released from the obligation to pay.

SIM-FLIGHT shall not be obliged to make a replacement delivery in the event of termination of the contract.

Payment options and retention of title

The customer has the payment options available that are indicated during the ordering process.

SIM-FLIGHT reserves the right to exclude customers from individual payment options or to insist on prepayment without providing a reason.

SIM-FLIGHT may charge default interest of 5% per year and a reminder fee of a maximum of CHF 20.- per reminder in the event of the customer's default in payment.

The goods delivered to the customer remain the property of Runway 34 Sim Academy AG until full payment has been received.

Cancellation / Rebooking / Substitution for simulator flights > Individuals

In the event of withdrawal / cancellation of a booking, the following costs will be incurred:

– 50% % of the invoice amount up to 48 hours before the agreed simulation flight appointment
– 100% % of the invoice amount for no-shows at the scheduled simulator flight

Bookings can be changed free of charge up to 48 hours before the start of the simulation flight. The appointment can be rescheduled once; thereafter, Runway 34 Sim Academy AG reserves the right to charge a fee of CHF 50.

A replacement person can be appointed at any time. This will not incur any costs.

Exempt from this: tickets from prize draws and special rates.

Cancellation / Rebooking for Simulator Flights > Groups

In case of withdrawal / cancellation of an event:

– 50% % of the invoice amount up to 48 hours before the start of the event
– 100 % des Rechnungsbetrages ab 48 Stunden vor Beginn des Anlasses/Ereignisses

Rebookings can be made free of charge up to 14 days before the start of the event. For rebookings made from 14 days before the start of the event, Runway 34 Sim Academy AG reserves the right to charge a rebooking fee of 20 % of the invoice amount.

For group bookings of 20 or more people (excluding private events), the following cancellation terms apply:

– 50 % des Rechnungsbetrages ab 10 Tage vor Beginn des Anlasses/Ereignisse
– 100 % des Rechnungsbetrages ab 48 Stunden vor Beginn des Anlasses/Ereignisses

In the event of the cancellation of a private limited company, the following contribution towards costs remains payable:

– up to 180 days before the appointment, CHF 1,000 processing fee
– 179-90 days before due date 25 % of order volume
– 89-45 days before deadline: 50% % of the order volume
– 44-15 days before term 75 % of the order volume
– 14–0 days before deadline 90 % of order volume

When combining your event with the Restaurant Runway 34, you will be asked to provide the exact number of people by the date specified in the banquet list. If this is not done in a timely manner, the number of people stated in the banquet list will serve as the basis for billing.

Accompanying persons / Spectators on simulator flights > Individuals

Viewers up to one person are possible at any time.

For a higher number of desired spectators, this must be agreed upon with Runway 34 Sim Academy AG before the start of the event.

Delivery, obligation to inspect, notice of defects and return of goods deliveries

Deliveries will be sent by post or courier to the address specified by the customer in the order. Invoicing will be carried out by online payment, email, or by post. With dispatch, the benefits and risks pass to the customer, insofar as this is legally permissible.

If delivery is not deliverable or the customer refuses to accept delivery, Runway 34 Sim Academy AG may terminate the contract after giving notice of the issue by email to the customer and setting a reasonable deadline, and may charge for the costs incurred.

The customer is obliged to inspect the delivered goods immediately upon receipt of the delivery and to report any defects for which Runway 34 Sim Academy AG provides a warranty to the address stated in the imprint in writing without delay, by letter or email.

Returns to Runway 34 Sim Academy AG are at the customer's own expense and risk. The customer must send the goods in their original packaging, complete with all accessories, along with the delivery note and a detailed description of the defects, to the return address specified in the imprint by Runway 34 Sim Academy AG.

If, upon inspection by Runway 34 Sim Academy AG, the goods are found to have no discernible defects or do not fall under the manufacturer's warranty, SIM-FLIGHT may charge the customer for the costs incurred, including return shipping or any disposal.

Validity of vouchers

Runway 34 Sim Academy AG vouchers are valid for 12 months from the date of issue shown on the voucher.

Warranty for goods deliveries

SIM-FLIGHT endeavours to deliver goods of impeccable quality. In the event of defects notified in good time, Runway 34 Sim Academy AG shall provide a warranty for the defect-free condition and functionality of the item purchased by the customer during the statutory warranty period, which is generally two years from the date of delivery.

It is at the discretion of Runway 34 Sim Academy AG to provide the warranty through free repair, an equivalent replacement, or a refund of the purchase price.

Further claims are excluded.

The guarantees do not cover normal wear and tear, nor the consequences of improper handling or damage by the customer or third parties, nor defects attributable to external circumstances. Likewise, the guarantee for consumables and wear parts (e.g. batteries, accumulators, etc.) is excluded.

Runway 34 Sim Academy AG cannot provide assurances or guarantees regarding the timeliness, completeness, and accuracy of the data, nor the constant or uninterrupted availability of the website, its functionalities, integrated hyperlinks, and other content. In particular, it is neither assured nor guaranteed that the use of the website will not infringe upon the rights of third parties not owned by Runway 34 Sim Academy AG.

Liability for the use of flight simulators

Despite regular maintenance of the simulator, malfunctions can occur, as with any complex technical system. In the event of technical malfunctions before or during a simulation flight, Runway 34 Sim Academy AG will offer the customer alternative dates for services not yet rendered.

If the service is substantially and significantly made more difficult, endangered, or impaired due to force majeure (e.g., war, civil unrest, natural disasters, etc.) that was unforeseeable at the time of contract conclusion, both the customer and SIM-FLIGHT can terminate the contract. In this event, Runway 34 Sim Academy AG will refund the price already paid, but may demand reasonable compensation for services already rendered.

Apart from this, Runway 34 Sim Academy AG accepts no liability; any liability is excluded to the extent permitted by law. In particular, Runway 34 Sim Academy AG expressly accepts no liability for any consequential costs incurred, for example, by participants' travel and/or hotel accommodation.

Individuals with health conditions (pacemakers, epilepsy, etc.) should not use the simulator. All liability is disclaimed.

General liability

Runway 34 Sim Academy AG excludes all liability, regardless of its legal basis, as well as claims for damages against Runway 34 Sim Academy AG and any auxiliary and vicarious agents. Runway 34 Sim Academy AG is in particular not liable for indirect damages and consequential damages, loss of profit or other personal injury, property damage and purely financial losses of the customer. Further mandatory statutory liability, for example for gross negligence or unlawful intent, remains reserved.

Runway 34 Sim Academy AG uses hyperlinks solely for the customer’s simplified access to other web offerings. Runway 34 Sim Academy AG can neither know the content of these web offerings in detail nor assume liability or other responsibility for the contents of these websites.

Data protection

Runway 34 Sim Academy AG may process and use the data collected during the conclusion of the contract for the fulfilment of its obligations under the purchase contract, and may also use it for marketing purposes. The data necessary for the fulfilment of services may also be transferred to instructed service partners (logistics partners) or other third parties.

Further provisions

Runway 34 Sim Academy AG expressly reserves the right to amend these General Terms and Conditions at any time and to bring them into effect without prior notice.

In the event of disputes, exclusively Swiss substantive law shall apply, to the exclusion of conflict of laws rules.

The UN Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.

The place of jurisdiction is Glattbrugg, insofar as the law does not provide for mandatory places of jurisdiction.
